Terminating a commercial agency relationship in the digital sector.
The termination of a cross-border commercial agency agreement can give rise to compensation claims and potential litigation. In such cases, identifying the appropriate legal strategy also means considering whether the dispute can be resolved before reaching the courts.
In this matter, a Dutch company required advice following the termination of its commercial agency relationship with a Belgian AI platform company, including the compensation potentially owed to the Dutch agent.
DLN members Tessa de Mönnink (the Netherlands) and Sandrine Kinart (Belgium) worked together on the matter, combining their respective expertise to assess the client’s position under the relevant legal frameworks.
Before initiating legal proceedings in Belgium, Sandrine Kinart engaged with the Belgian company in an attempt to reach an amicable settlement and resolve the compensation claim without litigation.
This project illustrates how DLN’s coordinated cross-border approach extends beyond identifying legal rights and potential claims. It also helps clients determine the most appropriate strategy for resolving international commercial disputes, including where an amicable solution may offer a more efficient path forward.
