[NL/BE] Parallel cross-border litigation following contract termination: a coordinated legal strategy

Coordinating parallel litigation following the termination of commercial relationships.

When the termination of cross-border commercial relationships leads to proceedings in more than one jurisdiction, coordinating the legal strategy becomes particularly important.

In this matter, a dispute arose between an American electronic devices brand and its Dutch distributor and Belgian commercial agent following the termination of their respective contractual relationships. Claims for compensation resulted in parallel proceedings before the Dutch and Belgian courts.

DLN members Tessa de Mönnink (the Netherlands) and Sandrine Kinart (Belgium) worked together on the matter, with Tessa handling the proceedings in the Netherlands and Sandrine the proceedings in Belgium.

Their cooperation enabled the litigation in both jurisdictions to be approached through a coordinated strategy, while taking account of the different legal frameworks governing the distributor and agency relationships.

This project illustrates the value of DLN’s cross-border model when a commercial dispute extends beyond a single jurisdiction, allowing clients to rely on specialised local representation within a coordinated European legal strategy.
