Examining international buying alliances from a Franco-Belgian legal perspective.
International buying alliances increasingly influence negotiations between suppliers and major retailers across Europe. Their cross-border structure can raise complex questions involving distribution law, competition law, applicable legislation and jurisdiction.
DLN members Adélaïde Robardey (France) and Sandrine Kinart (Belgium) shared their expertise on these issues at a conference organised by EFE Abilways, examining recent developments in international buying alliances from both French and Belgian perspectives.
Their contribution addressed the different structures used by buying alliances and the legal issues they create, including the impact of the French Descrozaille Law and recent court decisions concerning Belgian alliances with effects on commercial negotiations in France. They also considered the applicable law and competent jurisdiction when disputes arise.
The discussion highlighted why international buying alliances cannot always be assessed from a single national perspective. When purchasing structures and negotiations extend across borders, understanding how the relevant legal frameworks interact becomes essential for both suppliers and retailers.
This initiative reflects DLN’s broader role in bringing together specialised national expertise to address distribution issues with an increasingly European dimension.
