Managing regulatory compliance and sanction risks following a Belgian audit.
When products are marketed across borders, regulatory compliance must be assessed against the specific requirements of each national market. An inspection by local authorities can therefore require both knowledge of the client’s business and specialised expertise in the applicable local rules.
In this matter, a French company was audited by the Belgian authorities in connection with the sale of biocidal products through stores in Belgium. As the inspection was conducted under Belgian regulations, the company required local legal expertise to assess its position and respond to the authorities.
DLN members Jessica Ramond (France) and Sandrine Kinart (Belgium) worked together to prepare the client’s defence. Their approach included presenting the measures already implemented by the company to stop marketing the products concerned, with the aim of limiting or avoiding the proposed fine.
This project illustrates how coordinated cross-border advice can support businesses when distribution activities lead to regulatory scrutiny in another European jurisdiction.
